Géné Foncier is committed to full compliance with the General Data Protection Regulation (GDPR) and the French Data Protection Act. This page explains your rights and how to exercise them.


Your Rights Under the GDPR

Right of Access (Article 15)

You have the right to obtain confirmation that your personal data is being processed and to receive a copy of all data held about you. This includes your account data, genealogical content, usage logs and any other personal information.

Right to Rectification (Article 16)

You can request the correction of inaccurate data or the completion of incomplete data at any time. Most corrections can be made directly from your account settings.

Right to Erasure - Right to be Forgotten (Article 17)

You can request the deletion of your personal data when it is no longer necessary, when you withdraw consent, or when processing is unlawful. Account deletion includes a 30-day grace period, after which all data is permanently erased.

Exception for genealogy: The right to erasure may be limited when processing is carried out for archival or historical research purposes (Article 17.3.d GDPR). However, this exception primarily applies to public archives, not private platforms. Géné Foncier will process all erasure requests.

Right to Data Portability (Article 20)

You can receive your data in a structured, commonly used and machine-readable format. Géné Foncier guarantees export in GEDCOM format (genealogical data standard) as well as CSV and JSON formats for other data (sources, parcels, events).

Right to Object (Article 21)

You can object to processing based on our legitimate interest. We will then cease processing unless we can demonstrate compelling legitimate grounds that override your interests.

Right to Restriction of Processing (Article 18)

You can request restriction of processing while a dispute is being resolved (contested accuracy, objection pending review, etc.). Your data will be stored but not actively processed during this period.

Right to Withdraw Consent (Article 7.3)

When processing is based on your consent, you can withdraw it at any time. Withdrawal does not affect the lawfulness of processing carried out before withdrawal.


Rights Specific to Genealogy

Living Persons Mentioned in Family Trees

If you are a living person mentioned in a family tree on Géné Foncier without your consent, you can:

  • Request the tree owner to mask or delete your data
  • Contact Géné Foncier directly if the owner does not respond
  • Request the masking of data concerning your minor children

Géné Foncier automatically masks persons born less than 100 years ago without a recorded date of death.

Rights of Heirs (Article 85 French Data Protection Act)

The heirs of a deceased person may:

  • Access data useful for settling the estate
  • Request closure of the deceased's account
  • Request removal of data if disclosure could harm them
  • Exercise the digital directives left by the deceased

How to Exercise Your Rights

We will respond to your request within 1 month. This period may be extended to 3 months for complex requests, in which case you will be informed within the first month.

You may be asked to prove your identity to ensure the security of your data.


Filing a Complaint with the CNIL

If you believe that Géné Foncier does not adequately process your personal data, you have the right to file a complaint with the supervisory authority:
